Dated 17 April 1836
In the name of God amen: The 17th day
of April in the year 1836. I Jeremiah H. Phelps of the County of Tyrrell
and State of North Carolina, being in a low state of health in body, but of
sound mind and perfect memory, do make this my last Will and Testament, at the
same time utterly revoking all former wills made by me, declaring this to be my
last will and testament. Viz:
After all my just debts are paid, I give
and bequeath to my dearly beloved wife Mary the whole rest and residue of
my estate, whether real or personal, and every thing I am possed of whatsoever
and wheresoever to her and her disposal: at the same time I do appoint my well
beloved wife Mary executrix and two worthy friends i e Abraham Newbery
and Hardy Norman both of Washington County joint executors to this my
last will and testament to which I have hereunto set my hand and seal the day
and date above written.

The last will and testament of
Jeremiah H. Phelps was exhibited in open court and proved by the oath of
Susan D. Brickhouse who swore that he was of sound & disposing mind;
at the same time appeared in open court the executrix Mary Phelps and
qualifid to the same the executors therein named refusing.
