In the name of God amen I Joshua Phelps do make this my last Will and Testament-

First- I give my soul to God who giveth it and my body to buried in christion like manner-

Item 1st- my desire is that my lawful debts be paid by my exrs-

Item 2nd- I set off and lend to my wife Mary Phelps a certain part of my plantation whereon I live during her life Beginning at the bars running the road way by the house to a ceder & catauba standing in the yard thence through the field a direct course to a pine in Jones Armatrongs line thence with his line to Jones Armstrongs road way to the main road thence along the main road to the beginning at the bars- so as to inclose the dwelling house & yard and I also grant unto hur the use of one of the cribs & the use of the will- Item. 3rd- I give unto my wife Polly one bed & furniture one wollen wheel one clockreel one flax hackle & one coffe mill one chest one tea kettle & one spider & one flat iron & one sitting chair and two washing tables one keeler & pegin & pail & some crockery ware & candle moles-

4th Item- I give unto my beloved son Boid Phelps 50/ to be paid by my exer when called for.

Item 5th- I give unto my son Dorson Phelps 50/100

Item 6th- I give to my daughter Lucas fifty cents to be paid by my exr. when called for-

Item 7th- I give to my daughter Nancy Hopkins fifty cents-

Item 8th- I give to my son Burton Phelps one bed & furniture & two head of sheep

Item 9th- I give unto my son Roberson Phelps one gun-

Item 10th- I give to my beloved son Carny Phelps all of the balance of my estate both real & personal that is not heretofore given off by paying my lawful debts-
This is my last Will and Testament I do hereby appoint my beloved son Carny Phelps & Roberson Phelps my exers- Given under my hand & seal this the 3rd day of October A. D. 1848. & in the 72 year of indepndence signed in the presence of us.

Then was this paper writing exhibited in open court & upon the oath of David Clayton & Jones D. Armstrong the subscribing witnesses thereto was proved as the last Will & Testament of Joshua Phelps they further swore that the said Joshua Phelps was at the time of signing the same was of sound disposing mind & memory & that he signed the same without compulsion of any person & in our presence it is therefore admitted to probate in said court as the last Will & Testament of Joshua Phelps decd. & that the same be recorded-
